1. Introduction

These Terms and Conditions govern access to and use of the website operated by Illumus Unipessoal, Lda., hereinafter referred to as “Illumus”.

3. Purpose of the Website

This website presents Illumus, its expertise, services, projects, collections, materials, finishes and bespoke lighting solutions.

The information provided is institutional, commercial and informative in nature and is intended to assist clients, architects, designers and other professionals in assessing the solutions developed by Illumus.

The website does not operate as an online shop. Submitting a form or an enquiry only initiates contact with Illumus and does not, in itself, constitute acceptance of an order or the formation of a contract.

4. Enquiries and Project Consultations

Users may contact Illumus through the forms, email addresses, telephone numbers or other communication channels indicated on the website to request information, present a project or request a proposal.

Each request will be assessed according to its characteristics, technical requirements, intended timescale and available capacity. Any commercial commitment will be confirmed in writing.

5. Quotations and Commercial Proposals

Quotations and commercial proposals are prepared on the basis of the information available at the time of issue and remain valid for the period stated in the relevant document.

Prices may vary depending on factors including:

  • the dimensions and final configuration of the product;
  • the selected materials, components and finishes;
  • quantities;
  • technical, electrical or regulatory requirements;
  • site conditions and installation requirements;
  • packaging, transport and destination;
  • changes requested during the development of the project.

The elements included and excluded will be identified in the applicable proposal. Unless expressly stated otherwise, installation, transport, customs duties, local taxes, structural works and third-party services are not included.

6. Bespoke and Made-to-Order Products

Illumus develops bespoke and made-to-order products adapted to the specific characteristics and requirements of each project.

Before production begins, drawings, dimensions, materials, finishes, samples and other relevant specifications may be submitted for approval.

This validation stage is intended to ensure that the solution corresponds to what has been agreed and is suitable for the technical and architectural context of the project.

Natural materials, handcrafted finishes and manual production processes may present minor variations in colour, texture or appearance. These characteristics form part of the nature of the materials and artisanal production, provided that they remain within the appropriate tolerances for the approved product.

7. Orders and Formation of the Contract

An order is considered confirmed once the proposal has been accepted in writing by both Illumus and the client and the agreed initial conditions have been fulfilled.

Where applicable, the start of production is subject to:

  • approval of the drawings and specifications;
  • confirmation of materials and finishes;
  • receipt of the agreed initial payment;
  • provision of the necessary technical information.

Changes requested after approval will be reviewed with the client and may require an adjustment to the price, technical solution or expected timescale.

8. Payment Terms

Payment terms are defined in each quotation, order confirmation or separate commercial agreement.

In the event of a delay in payment, Illumus will seek to resolve the matter directly with the client. Where necessary, work or dispatch may be temporarily suspended until the outstanding amount has been settled.

Banking, currency exchange, customs or tax costs not expressly included in the proposal will be borne by the party to whom they are legally or contractually attributable.

9. Timescales

The indicated timescales are calculated according to the complexity of the project, the availability of materials and the information available when the order is confirmed.

The timescale will normally begin once the approvals, technical information and payments required to commence the work have been received.

Whenever a circumstance arises that may affect the expected schedule, Illumus will seek to inform the client and coordinate an appropriate solution for the project.

10. Delivery, Transport and Installation

Delivery, transport and installation conditions will be defined in the proposal or order confirmation.

To ensure a safe and appropriate installation:

  • the site must provide access and conditions compatible with the product;
  • structural supports, fixing points and electrical supplies must be checked beforehand;
  • installation must be carried out by suitably qualified professionals;
  • the product and packaging must be inspected upon receipt.

Where visible transport damage is identified, it should be noted on the carrier’s delivery documentation and reported to Illumus with photographs and the available supporting information, so that the matter can be assessed as quickly as possible.

11. Product Information and Visual Representation

Illumus seeks to present the characteristics, dimensions, materials and finishes of its solutions as accurately as possible.

Photographs, rendered images and digital samples are representative in nature. The perception of colours and textures may vary depending on the screen, ambient lighting, materials and production processes.

For each order, the expressly approved drawings, specifications and commercial documents will prevail.

12. Intellectual Property

The texts, images, drawings, rendered images, concepts, technical solutions, designs, trademarks, logos and other content presented on the website are protected by the applicable intellectual property legislation.

The reproduction, adaptation, distribution, commercial exploitation or use of this content to develop or manufacture products requires the prior authorisation of the relevant rights holder.

13. Responsible Use of the Website

The website must be used lawfully and responsibly, with respect for the rights of Illumus, other users and third parties.

The website may not be used for the purpose of:

  • interfering with the operation or security of the website;

To the extent permitted by applicable law, Illumus may not be held liable for damage directly resulting from temporary website failures, misuse of its content or services operated by third parties.

This provision does not exclude or limit any liability or rights that cannot lawfully be excluded or limited.

18. Consumer Rights

Whenever the contractual relationship qualifies as a consumer contract, the mandatory rights provided for under Portuguese and European Union law will apply, including rights relating to the conformity of goods.

For consumer contracts concerning movable goods, statutory liability for lack of conformity applies for the period established by the legislation in force, currently three years from delivery of the goods, without prejudice to any specific regime that may apply.

Any commercial guarantees provided by Illumus supplement and do not replace the consumer’s statutory rights. The applicable conditions are described on the Warranty and After-Sales Service page.

In contracts concluded at a distance or away from business premises, a right of withdrawal may apply in accordance with the relevant legislation.

Where legally applicable, the right of withdrawal does not apply to the supply of goods made to the consumer’s specifications or clearly personalised. The applicability of this exception will be assessed according to the specific characteristics of the order and the legislation in force.

19. Complaints and Alternative Dispute Resolution

In the event of a consumer dispute, the consumer may contact the National Centre for Consumer Conflict Information and Arbitration — CNIACC, the competent entity for the municipality of Águeda, without prejudice to any other body legally competent to deal with the matter. 20. Applicable Law

These Terms and Conditions are governed by Portuguese law, without prejudice to any mandatory rules that may apply, particularly in relation to consumer protection and jurisdiction.

21. Changes to These Terms

These Terms and Conditions may be updated to reflect legal, technical, operational or commercial changes.

The version in force will be identified by the update date shown on this page, without affecting the conditions previously agreed for orders that have already been confirmed.
